POLL: Should California Ban the 'Bullet Button?'

The bullet button gets around the state law banning semi-automatic guns and those with removable magazines.

Earlier this week, California Senator Leland Yee (D-San Francisco/San Mateo) was given the Vanguard Award for "Elected Official of the Year" for his work in social justice.

We also reported that one of the biggest efforts Yee is working on currently is a Senate bill to ban the "bullet button" in California.

That certainly got people talking.

In California, an "assault weapon" is defined as a semi-automatic rifle with both a pistol grip and a detachable magazine, among other features. A "bullet button" is designed to replace a normal magazine release button with a recessed button that can only be accessed through the use of a tool—such as the tip of a bullet.

The California Department of Justice (CA DOJ) declared that semi-automatic rifles utilizing a bullet button are considered to be "fixed magazine" rifles, and therefore legal under the state's assault weapon ban. This was most recently reaffirmed in April of 2011 in the case of Haynie vs. Pleasanton, wherin the CA DOJ said that the arrest of an individual with such a rifle was without cause, as such a rifle is legal.

Yee disagrees. Though the bullet button still slows down a person's ability to change magazines, Yee argues that it should still be banned for safety reasons, calling assault weapons and bullet buttons "public nuisances."

People all over the state - and across the country - feel passionately about the issue of bans on assault weapons and bullet buttons.

Many say such a ban is useless; that people who want to kill will find a way, and that whether or not bullet buttons and semi-automatic assault weapons are banned won't make a difference. Therefore, the ban would only punish law-abiding citizens who use guns and bullet buttons safely.

Others say, tragedies like the Aurora, Colo. movie theater shooting - which Yee has been using as a reason to push the bill even harder lately - are proof that more gun control is needed in this country.

That may have been Jefferson's mindset. It may have been the mindset of any number of the Founding Fathers, but where did they include in the Constitution the right to ignore the law? Where did they include in the Constitution the idea that it is an individual's right to oppose the enforcement of law with arms. I'll say it again ... what you and others believe is a system that would lead to anarchy and what the Founding Fathers did was draft a document that set up a system of government founded on the rule of law. The furthest thing from anarchy.

I guess you missed the word "unjust". In his quote. They formed a government with a constitution that severely limited it's power.
One that was based on personal freedom, and states rights. They wanted more control at the local level. Were people wrong to disobey laws in place to stop run away slaves, or your personal favorite sodomy laws.

Greg ... it's a pointless conversation. You believe that every individual has the right to decide for him or herself which laws they want to follow. That's called anarchy. No society has ever survived that way and there is nothing in the Constitution or Bill of Rights that would suggest individuals have that right.

Greg ... who gets decide which laws are unjust and shouldn't be followed? Which laws should not just be ignored, but for which arms should be taken up if enforced? Trust me, I get the idea that some laws are unjust (Hitler's Germany, slavery, and plenty of other examples). The problem is the few examples you cited on the other thread are laws that many, of not most, people would find to be reasonable.
Let me put it another way ... is it an individual right to ignore "unjust" laws or a collective right to ignore "unjust" laws. If individual ... who gets to decide? Oddly enough, again, I have never denied to you, or anybody else in this country, the right to arm themselves to protect themselves and their family in their own home. Why do you need an AK 47 with a detachable clip to protect yourself in your own home? But, let's go back to one of your quotes ... explain how an AK-47 is a commonly owned weapon.

the senator is using fear tactics to get publicity. There are no documented cases in California of gun related crimes where the use of a bullet button equipped rifle made a difference in the crime. Most criminals already use large capacity magazines that are outlawed except for "grandfathered" guns under legal exceptions and those are brought in from elsewhere. The net result will be regular citizens will not be able to buy a weapon where they can easily change magazines while the criminals will still be using illegal magazines and rifles purchased elsewhere and smuggled into California. tell the residents of Stockton you want to hamper their ability to fight back against gangs armed with AUTOMATIC weapons, massive magazines, and armor piercing rounds as they lay on the floor of their houses with rounds flying by them and through their families bodies. Gangs only run when you shoot back. Cops never arrive until the victoms are dead. Tell Senator Yee that the next time he wants to get on his high horse. His awards don't mean anything when those awards help kill innocent people.

I work in stockton in the 911 system and have for 7yrs I can tell you most shooting are from hand guns not AR-15's or AK's.
